A 5th U.S. Circuit Court of Appeals ruling on Nov. 18 paves the way for a second criminal trial for Houston plaintiffs attorney Warren Todd Hoeffner. Hoeffner represented more than 900 individuals who brought silicosis or silica-related personal-injury claims against manufacturers and sellers of products containing silica. He was indicted for allegedly paying the two employees of The Hartford, an insurer of the silica companies, $3 million in cash, luxury cars, spa treatments and trips to secure $34 million in settlements.

In a 19-page per curiam opinion, the 5th Circuit found that a second trial — without an honest-services fraud allegation — would not violate Hoeffner’s double-jeopardy protections.
