On March 10, a jury determined that a home-building company wasn’t liable for injuries a contractor sustained when he fell off a ladder. In 2007, Henry Saenz, a stucco contractor, fractured his heel when he fell from the ladder while working at a residential construction site in Frisco. He blamed builder Edward Brussell, alleging one of its employees negligently used a power-washer, which washed water and mud under the ladder. Saenz claimed the dangerous muddy condition caused the ladder to slip. He sought more than $60,000 in damages. The builder denied that its employee was using the power-washer. It also argued that Saenz’s ladder was old and in poor condition.
