On Jan. 8, a judge ruled against an aviation inspector who claimed he was passed over for promotions and reassigned to desk duty because of his age. In 2006, Gene M. Bland quit his job as an aviation inspector for the Federal Aviation Administration after he was placed on desk duty for allegedly misusing a government vehicle. Bland alleged that during his 16 years of employment, he was rejected for three promotions in favor of younger, less-experienced candidates. He contended the FAA’s discrimination against older workers was the reason he wasn’t promoted and that it ultimately resulted in what he considered to be constructive discharge. The defense denied discrimination. It argued Bland wasn’t promoted because he didn’t get along with his supervisors and was hard to deal with as an employee.
