Due to an error by senior reporter Mary Alice Robbins, the description of proposed Texas Disciplinary Rule of Professional Conduct 1.08(g)(2) was incorrect in "Proposed Disciplinary Rule Changes Target Conflicts, Scienter , Sex," Texas Lawyer, Oct. 26, 2009, page 15. Proposed Rule 1.08(g)(2) prohibits a lawyer from making an agreement with a client unless that client is represented by independent counsel in making the agreement or the lawyer discloses to the client the scope of the issues to be arbitrated, that the client will waive a trial by judge or jury on the issues, and that the client's rights of appeal may be limited.
