Man who rolled 18-wheeler after truck cut him off wins $1,789,049

A jury in a Fort Bend County district court has awarded $1,789,049 to a trucker who blamed a Frito-Lay delivery truck for making him lose control and roll his 18-wheeler.

On Nov. 21, 2005, Clinton Abbott was driving on the interstate near Katy when a Frito-Lay vehicle allegedly cut in front of him. He lost control of his tractor-trailer, struck two cars and overturned.

Abbott sustained a broken leg, neck injuries, permanent tissue damage to his calf and spleen injuries. He underwent four surgeries, including removal of his spleen and a two-level cervical fusion.

Frito-Lay argued that its truck didn't cause the accident and that no Frito-Lay vehicle was near Abbott that day. The jury disagreed, and on April 27 awarded Abbott the full amount he was seeking.
