The Bennett Law Firm in Houston sought to recuse 334th District Judge Sharon McCally in a case involving the firm’s fee dispute with another attorney. But a different judge found the recusal motion “frivolous” and sanctioned the firm. Now the firm and its attorney in the fee dispute, Robert S. Bennett, face the possibility that McCally will order sanctions against them. Bennett is a principal in the firm.
On March 23, McCally signed a second show-cause order on a motion for contempt and motion for sanctions that Houston solo Scott Rothenberg filed March 9, seeking to have Bennett and the firm held in contempt in Rothenberg v. The Bennett Law Firm .As noted in the order, McCally has set a hearing for April 17.
