5th Circuit Largely Upholds Convictions of Two Border Patrol Agents

The 5th U.S. Circuit Court of Appeals on July 28 largely upheld the criminal convictions of two U.S. Border Patrol agents who shot at a fleeing drug smuggler while on duty along the U.S.-Mexico border. Significantly, the panel upheld the convictions under 18 U.S.C. §924(c) — using a gun in relation to the commission of a crime of violence — which requires a mandatory minimum sentence of 10 years.
