The 5th U.S. Circuit Court of Appeals on July 28 largely upheld the criminal convictions of two U.S. Border Patrol agents who shot at a fleeing drug smuggler while on duty along the U.S.-Mexico border. Significantly, the panel upheld the convictions under 18 U.S.C. §924(c) using a gun in relation to the commission of a crime of violence which requires a mandatory minimum sentence of 10 years.
