Kopplow Development Inc. v. City of San Antonio

A landowner sued a municipality after it built a facility partly on the property that would detain storm water on the property in a significant flood, thus causing the property to be undevelopable without additional fill. Because the landowner's claim is for the present inability to develop the property as previously approved unless the property is filled, the claim is not premature. The court of appeals' judgment is reversed and remanded. Texas Supreme Court, No. 11-0104, 03-08-2013.
