The appellants challenge the appellees' reliance on "dog-scent lineups," which a police officer conducted and which municipalities used to arrest, charge and hold the appellants. Winfrey, a recent decision, resolved legal issues that directly parallel those raised in this appeal and that addressed much of the same evidence. However, unlike in Winfrey, tapes of two of the lineups are in the record on appeal and there is independent and untainted evidence corroborating the results of the lineups. The district court's summary judgment is affirmed. 5th U.S. Circuit Court of Appeals, No. 11-20906, 03-06-2013.
