Tx. App. Dist. 5

March 11, 2013

The petitioner asks for a writ of mandamus preventing the assigned judge from reconsidering her recusal order. A judge who has actually been recused should not file a motion for reconsideration of that decision. The assigned judge acted contrary to settled law when she granted the motion for reconsideration. The writ is conditionally granted. Dallas Court of Appeals, No. 05-12-01500-CV, 03-06-2013.
