The plaintiff appeals from the district court's dismissal of his suit alleging claims of equitable estoppel and breach of fiduciary duties pursuant to the Employee Retirement Income Security Act. Amara's pronouncements about surcharge as a potential remedy under §502(a)(3) should be followed. The district court's dismissal is affirmed in part, and reversed and remanded. 5th U.S. Circuit Court of Appeals, No. 12-60461, 02-19-2013.
