The district court denied the appellant's motion to suppress marijuana allegedly found in a house. A violation of the prophylactic Miranda rule does not require suppression of the non-testimonial physical fruits of the suspect's unwarned but voluntary statements. Consent following an unwarned confession may be voluntary. The judgment of conviction is affirmed. 5th U.S. Circuit Court of Appeals, No. 11-41365, 02-15-2013.
