Harris County Housing Authority v. Rankin

Tex. App. Dist. 1

February 5, 2013

The Harris County Housing Authority appeals the trial court's denial of its motion to dismiss for lack of jurisdiction. The Housing Authority, having waived immunity from suit by contracting for services with the appellee, may not now claim immunity from suit brought to enforce an agreement that settled claims arising under that contract for services. The appellee's fraud claim is barred by governmental immunity. The trial court's order is reversed in part, affirmed in part, and remanded. Houston's 1st Court of Appeals, No. 01-12-00870-CV, 01-31-2013.
