State v. Ninety Thousand Two Hundred Thirty-Five Dollars and No Cents

Tx. Sup. Ct.

January 30, 2013

The court of appeals affirmed a trial court's judgment upholding the forfeiture of a vehicle and $90,235 found in it following a traffic stop. Probable cause, in the context of civil forfeiture, is a reasonable belief that a substantial connection exists between the property to be forfeited and the criminal activity defined by the statute. The appellee's affidavit failed to address whether the officers had a reasonable belief that the property had or would have a substantial connection with illegal activity as pleaded by the state. The court of appeals' judgment is reversed and remanded. Texas Supreme Court, No. 11-0642, 01-25-2013.
