Ex Parte Murillo

Tex. App. Dist. 14

January 10, 2013

The applicant appeals the habeas court's denial of his post-conviction application for writ of habeas corpus, arguing that he was denied effective assistance of counsel. In the Padilla context, the applicant must prove there is a reasonable probability that but for plea counsel's errors, he would not have pleaded guilty, which requires proof that a decision to reject the plea bargain was rational under the circumstances. The habeas court's judgment is affirmed. Houston's 14th Court of Appeals, No. 14-12-00090-CR, 01-08-2013.
