A jury found the appellant guilty of aggravated assault with a deadly weapon. Pre-arrest, pre-Miranda silence is not protected by the Fifth Amendment right against compelled self-incrimination, and prosecutors may comment on such silence regardless of whether a defendant testifies. The trial court's judgment is affirmed. Houston's 14th Court of Appeals, No. 14-11-00685-CR, 01-08-2013.
