Newman v. Guedry

James Guedry and David Burke appeal the denial of their motion for summary judgment based on qualified and official immunity from Derrick Newman's 42 U.S.C. §1983 excessive-force and state-law claims. Because the officers' use of force was not objectively reasonable, it was not in good faith, so the officers are not entitled to official immunity on Newman's state-law claims. The appeal is dismissed for want of jurisdiction.5th U.S. Circuit Court of Appeals, No. 11-41192, 12-21-2012.
