McCulloch v. Brewster County

Tex. App. Dist. 8

December 26, 2012

The appellants challenge a declaratory judgment declaring that Mills Road is a county road, which was impliedly dedicated to public use. Because the origin of Mills Road is shrouded in obscurity and there is evidence of long and continued use of the road by the public, there is a presumption that the landowner intended to dedicate Mills Road. The trial court's judgment is affirmed. El Paso Court of Appeals, No. 08-11-00270-CV, 12-21-2012.
