K.A., a minor, appeals a judgment finding that he engaged in delinquent conduct by committing the penal offense of retaliation. The erroneous omission of the "as a public servant" element of the retaliation offense in the court's charge to the jury vitally affected K.A.'s defensive theory and struck at the very basis of his case.
