K.A., a minor, appeals a judgment finding that he engaged in delinquent conduct by committing the penal offense of retaliation. The erroneous omission of the "as a public servant" element of the retaliation offense in the court's charge to the jury vitally affected K.A.'s defensive theory and struck at the very basis of his case. The trial court's judgment is reversed and remanded. Amarillo Court of Appeals, No. 07-11-00326-CV, 12-20-2012.
