Stanley v. Bell County District Clerk

Tex. Crim. App.

December 13, 2012

The relator asserts that the district clerk refused to accept a habeas application for filing. Although the district clerk has the authority to return an application when an applicant is not using the correct form, the relator appears to have used the correct form and appears to have substantially complied with the instructions. Mandamus relief is conditionally granted. Court of Criminal Appeals, No. AP-76,929, 12-12-2012.
