State v. Richardson

Tex. Crim. App.

November 27, 2012

The state appealed the trial court's refusal to let it use Iowa convictions to enhance the punishment range of the charged offense. The court of appeals dismissed for lack of jurisdiction. By deleting the enhancement paragraphs, the trial court's order affected the face of the charging instrument. The court of appeals' judgment is reversed and remanded. Court of Criminal Appeals, No. PD-1867-11, 11-21-2012.
