Kelly v. Hinson

Tex. App. Dist. 2

November 27, 2012

The appellants claim that the trial court erred by failing to rule on their motion to compel arbitration prior to granting summary judgment in favor of appellees. Appellants' motion to compel arbitration -- signed by a non-lawyer manager ? was not void ab initio, and its unobjected-to, pro se status did not excuse the trial court from performing the ministerial duties of setting the motion for a hearing and ruling on it. The trial court's summary judgment is reversed and remanded. Fort Worth Court of Appeals, No. 02-12-00058-CV, 11-21-2012.
