In Re: Miller

Tex. App. Dist. 7

November 6, 2012

The relator seeks a writ of mandamus ordering the trial judge to vacate his judgment based on the assertion that the trial court lacked jurisdiction. The substance of the relief sought is a request for post- conviction habeas corpus relief. Courts of appeals have no jurisdiction over post-conviction writs of habeas corpus in felony cases. The petition is dismissed. Amarillo Court of Appeals, No. 07-12-00440-CV, 11-02-2012.
