The relator petitions for writ of mandamus seeking to vacate the trial court's order denying its motion to dismiss on grounds of forum non conveniens. The underlying case involves a well blow-out in Louisiana that caused the release of salt water, hydrocarbons and formation materials. If this case is dismissed on forum non conveniens grounds, the limitations period would remain tolled for 30 days, which would allow the Alcee plaintiffs time to file suit in Louisiana. The Texas Civil Practice and Remedies Code §71.051(b) factor weighs in favor of dismissing the case on forum non conveniens grounds. The writ is conditionally granted.
