In this title dispute, the appellant complains that the judgment is void because the court adjudicated the land ownership dispute between the parties as a declaratory judgment when Texas law requires that disputes about ownership be litigated in a trespass-to-try-title action. The trial court had subject matter jurisdiction of the plaintiff's claims, including the trespass to try title and suit to quiet title. The inclusion of the requests for declaratory relief did not deprive the trial court of subject matter jurisdiction. The trial court's judgment is affirmed. El Paso Court of Appeals, No. 14-12-00272-CV, 11-06-2012.
