Tex. App. Dist. 7

October 22, 2012

The relator complains that a municipal court clerk has refused to file a document wherein he requests DNA testing. Unless necessary to enforce its jurisdiction, the court of appeals has no jurisdiction to issue a writ of mandamus against the municipal court clerk. The appeal is dismissed for want of jurisdiction. Amarillo Court of Appeals, No. 07-12-0441-CV, 10-18-2012.
