Greenwood v. Lee

The appellants, Kyle and Beverly Greenwood, defendants and counterplaintiffs below, appeal the trial court's summary judgment which declared the scope of an easement and respective rights of the Greenwoods as owners of the dominant estate and neighboring servient estate owner, Martha Lee. No words in the grant specifically limit the Greenwoods' use to a specific roadway then in use or to that part of the easement which may be necessary or convenient. The trial court's judgment is reversed to the extent that it limits the Greenwoods' rights in connection with the easement to a road not to exceed 20 feet in width; the judgment is otherwise affirmed.
