The plaintiff in this age-discrimination case was replaced by an older worker. The court of appeals held that an age-discrimination plaintiff can meet her prima facie burden by alleging she was replaced by someone younger or by otherwise showing that she was discharged because of age. A plaintiff who is replaced by an older worker does not receive the inference of discrimination afforded by the prima facie case. The court of appeals' judgment is reversed and rendered. Texas Supreme Court, No. 10-0802, 06-29-2012.
