In an action for a religious observance accommodation under Title VII, the plaintiff appeals from the district court's ruling on summary judgment that the appellant's employer reasonably accommodated his religion. Summary judgment is not appropriate at this stage because there are genuine disputes of material fact regarding the very nature of the purported accommodation in this case. The district court's judgment is vacated and remanded. 5th U.S. Circuit Court of Appeals, No. 11-31126, 04-10-2013.
