In this condemnation case, a divided court of appeals upheld two regional public transportation authorities' assertion of governmental immunity and dismissed the case. Texas Utilities Code §37.053(d) waives governmental immunity. The court of appeals' judgment is vacated and remanded to the trial court. Texas Supreme Court, No. 11-0079, 06-22-2012.
