In Pennsylvania, the Environmental Hearing Board adjudicates challenges to final actions of the Pennsylvania Department of Environmental Protection. Hearings before the board are de novo, and are conducted much like a case in a trial court, albeit at times with relaxed evidentiary rules. Because its jurisdiction is limited to reviewing final actions of the department, the board has developed considerable expertise in adjudicating environmental disputes.

On Oct. 12, Judge Terrence F. McVerry of the U.S. District Court for the Western District of Pennsylvania granted motions by the defendants in United States v. EME Homer City Generation to dismiss federal Clean Air Act and Pennsylvania Air Pollution Control Act enforcement actions brought by the U.S., the Commonwealth and the downwind states of New Jersey and New York concerning the Homer City power plant.

In July, the Commonwealth Court decided a case under the Environmental Rights Amendment to the Pennsylvania Constitution. Energy Conservation Council of Pennsylvania v. Public Utility Commission upheld the Public Utility Commission's decision to allow an electric utility to construct a transmission line over challenges raised by environmental groups and the Office of Consumer Advocate under, among other things, Article I, Section 27, of the state constitution.

This groundbreaking 137-page report contains a vast array of non-binding policy recommendations pertaining to Pennsylvania's natural gas boom ranging from zoning reform to mineral rights. Included among these are a series of recommendations that could substantially transform Pennsylvania's existing environmental policy landscape in the coming months.
