In 2006, claimant's attorneys and the Chamber of Commerce welcomed the expansion of workers' comp settlements and mandatory mediation. Seven years on, are settlements increasingly favoring the employer?
At 7 p.m. today live on the Philadelphia CNN-News affiliate WFMZ-TV, The American Law Journal presents "Workers' Comp and the Culture of Settlement." Joining host Christopher Naughton are claimant's attorney George Badey of Badey, Sloan & DiGenova and respondent's counsel Laurie A. Carroll of Naulty, Scaricamazza & McDevitt. Workers' Compensation Judge Joseph Hakun rounds out the panel that questions whether employees have been losing ground in the last seven years, especially as it relates to ongoing medical costs.
"There is a resignation culture, too," Hakun said. "You are seeing that when an employee is getting up in years and perhaps it's been a contentious comp matter, employers are increasingly asking the worker to resign."
