Defense lawyers' best new evidence tool? It's right on their desktop.
Tonight at 7 on the Philadelphia CNN-News affiliate WFMZ-TV, The American Law Journal presents, "Social Media, Surveillance and the Injured Worker." Joining host Christopher Naughton are claimant's lawyers George J. Badey III of Badey, Sloan & DiGenova and Halmon L. Banks III of Martin Banks, respondent's counsel Anthony P. Salvino of White and Williams and Workers' Compensation Judge Joseph Hakun.
"Every new case that comes in [we] just Google the name, we'll look at Facebook ... and I have had cases where injured workers talk about going cross-country on a motorcycle," Salvino said. "I absolutely love Facebook."
"I tell my client it's the 'six o'clock news rule,'" Badey said. "If you say something on Facebook, it's the equivalent of, 'Would I be embarrassed or could this hurt me if it were broadcast on the six o'clock news?'"
The American Law Journal airs on Mondays at 7 p.m. as well as Sundays at 5:30 p.m. on the CNN-News affiliate for Philadelphia, WFMZ-TV 69. Visit http://bit.ly/ALJchannels for all cable and satellite systems. FiOS system subscribers tune to channel 15.
