I represent Mitchell Partners in Mitchell Partners v. Irex and, as I indicated to The Legal two weeks ago, it is not my habit to communicate with the press. However, The Legal 's recent reporting on the Mitchell Partners decision ("Dissenters Given Narrow Post-Merger Recourse," published July 30 in The Legal and "Rare Certification Procedure Keeps Federal Courts From Guessing," published July 31 in Pennsylvania Law Weekly ) reflects certain observations upon which I'm obliged to comment.
