A Lackawanna County judge has allowed a family of business owners to proceed with their suit against a bank for honoring forged checks, despite the bank’s protests that the business owners were negligent for entrusting the monitoring of its bank account to the bookkeeper who was forging the checks.

Lackawanna County Court of Common Pleas Judge Terrence Nealon denied defendant Citizens Savings Bank Inc.’s motion for summary judgment with regard to claims that it had violated the Pennsylvania Uniform Commercial Code by cashing 86 checks forged by a former employee of the plaintiffs.
