An attempt by the Republican National Committee to vacate a 30-year-old consent decree with the Democratic National Committee in which the RNC agreed not to police voter fraud without a court’s permission fell flat with the 3rd U.S. Circuit Court of Appeals.

The RNC had argued that subsequent modifications to and interpretations of the decree as part of lawsuits alleging the RNC violated the decree made it more prohibitive against RNC ballot protection efforts than initially envisioned when the decree was signed in 1982. It also argued subsequent changes in the law over 30 years required the decree be vacated or at least modified.
