As the president of a nonprofit corporation, I find myself frequently presented with issues very similar to those faced by many of my clients. Having counseled nonprofit organizations for more than seven years, I have gained insight into both the legal and practical issues they routinely confront.
The first step in handling any of these issues, I’ve found, is to determine the right person to help address it. If the issue is legal, contact your attorneys — be they in-house or outside general counsel — to make them aware of the situation and request advice. If the issue is practical, determine if it’s recurring and whether it can be resolved by incorporating it into a board manual (more on that later) or by preparing a notice or policy.
