In light of the U.S. Supreme Court’s decision in Bruesewitz v. Wyeth , the state Supreme Court has vacated the Superior Court’s ruling in the products liability case of an 11-year-old autistic boy.

Last February, the U.S. Supreme Court ruled 6-2 in Bruesewitz that the federal National Childhood Vaccine Injury Act pre-empts all vaccination design defect claims brought against vaccine makers in state court.
