The Port Authority of Allegheny County cannot refuse to run ads on its buses that inform felons in Pennsylvania of their right to vote because it has previously allowed ads that promoted education about other legal rights, the 3rd U.S. Circuit Court of Appeals has ruled.

The unanimous three-judge panel concluded that the authority engaged in “viewpoint discrimination” because it rejected the ads despite allowing ads with other messages about legal rights including women’s rights, fair housing and tax information for the poor.
