The state Supreme Court has rebuffed some Pennsylvania landowners by agreeing with oil and gas industry arguments that royalty payments for gas extracted from their land do meet the minimum levels established in a 1979 state law, the Minimum Royalty Act.
In Kilmer v. Elexco Land Services Co., the landowners were attempting to void their contracts with the oil and gas producers by contending the payments did not meet the minimum.
