The state Supreme Court has granted allocatur in a case that will determine the constitutionality of a Pennsylvania statutory provision that allows for grandparent visitation rights upon the death of a child’s parent.

In its May opinion in Fausey v. Hiller, a Superior Court panel ruled that Section 5311 of Pennsylvania’s Domestic Relations Code is constitutional, rejecting father Shane Fausey’s argument that that provision violates his due process right to raise son Kaelen in the manner he deems best.
