On March 10, 2011, plaintiff Dontay Tabbs, 26, a tow truck operator, was stopped in traffic on Interstate 676 in Philadelphia when the rear of his Dodge Charger was struck by the front of a vehicle driven by Ayelet Meron, who had been rear-ended by a vehicle driven by Timothy Leonard. Tabbs claimed that he suffered a lumbar herniation, which he alleged pierced the limited-tort threshold.
