Police Commissioner Raymond Kelly has the power to prevent an officer involved in the shooting death of Amadou Diallo from carrying a gun on the job, a federal judge has ruled.

Southern District Judge Sidney Stein found, in Boss v. Kelly, 07 Civ. 2113, that Kenneth Boss failed to state a valid claim “for the deprivation of any constitutionally protected property or liberty interest without due process” when he sued for restoration of gun privileges.
