The Appellate Division, First Department, needed a year-end cash infusion after replacing 44 of 46 employees who took early retirement last fall. The OCA's budget office averted a projected $400,000 shortfall by transferring surplus funds from the Second Department. "We are a busy court and took a big hit" when the employees retired, Presiding Justice Luis A. Gonzalez of the First Department said in an interview yesterday. "I made the decision that we needed the personnel to serve the public."
