ALBANY – Democrats who dominate the New York Assembly are adamantly opposed to capping non-economic awards for medical malpractice, such as for pain and suffering, the chairwoman of a key committee said yesterday.

Assembly Judiciary Committee Chairwoman Helene Weinstein said Democrats have taken the position that the pain-and-suffering cap of $250,000 being pushed by Governor Andrew M. Cuomo would work against the interests of women, the elderly, children and others with lower incomes who may have a claim for a grievous injury caused by medical professionals.
