An upstate appellate panel has affirmed the conviction of a Rochester-area funeral director who was sentenced to up to eight years in prison for harvesting and selling body parts without consent.
The unanimous Appellate Division, Fourth Department, panel rejected defendant Scott Batjer’s argument that he “innocently and unknowingly” participated in an illegal anatomical gift program “in good faith,” holding that there is no “good faith” exception under the applicable section of the Public Health Law.
