For the second time in two months, the U.S. Court of Appeals for the Second Circuit has vacated a long prison term for a child pornography defendant that was driven by automatic enhancements in the sentencing guidelines.
The circuit Friday tossed out the 14-year prison sentence that Jason E. Tutty was ordered to serve by Western District Judge Charles J. Siragusa after Mr. Tutty pleaded guilty to one count of receiving child pornography and admitted to possessing between 150 and 300 digital images of children.
