Citing “chronic” delays by New York City, Eastern District Judge Nicholas G. Garaufis has appointed former Manhattan District Attorney Robert M. Morgenthau as a special master to oversee remedial measures in the discrimination suit filed against the city on behalf of black and Hispanic firefighter applicants.

“This court is thoroughly unconvinced by the City’s justifications for the delay. More importantly, however, it does not have the time or inclination to launch an investigation into the arcana of the City’s procurement policy, or any other policy,” Judge Garaufis wrote in United States v. City of New York, 07-cv-2067. “This court cannot pore over the City charter, untangle the City’s administrative hierarchy, and hold hearing after hearing each time the City invokes some wrinkle of local governance to postpone the imposition of a remedy.”
