One of the U.S. Justice Department’s top appellate lawyers will argue for the government in a pending health care challenge that a federal appeals court will hear on Sept. 23. Beth Brinkmann, who leads the Civil Division’s appellate section, will try to convince the U.S. Court of Appeals for the D.C. Circuit to uphold U.S. District Judge Gladys Kessler‘s ruling in February dismissing a suit over the minimum-coverage provision of the Obama administration’s health care legislation.
DOJ lawyers said in court papers the new law “seeks to ameliorate the crisis in the market for health care services.” Brinkmann enters the oral argument with a winning record in the D.C. Circuit. The former head of Morrison & Foerster‘s appellate and U.S. Supreme Court practice has won two cases she argued for DOJ, including the injunction dispute involving human embryonic stem cells.
