It may not be the recent decision in California's Proposition 8 case or even the pending challenges to the federal Defense of Marriage Act that entice the Supreme Court to answer the essential question: Is there a fundamental right to same-sex marriage? However, it will not be for lack of trying by those involved in the issue.
